Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Site operated by AgenticAssure. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Enterprise customers. If you purchase or use AgenticAssure's commercial products, your use is governed by the written agreement between you and AgenticAssure. If there is a conflict between these Terms and that agreement, the agreement controls for the paid Services.

Services and website

We may describe our products and capabilities on the Site for informational purposes. Features referenced on the Site may change. We do not guarantee that any particular feature will be available except as stated in a separate contract.

Accounts

If you create an account, you must provide accurate information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly at contact@agenticassure.ai if you suspect unauthorized access.

Acceptable use

You agree not to:

• Use the Site to violate any law or infringe others' rights;
• Attempt to gain unauthorized access to our systems, other users, or third-party networks;
• Interfere with or disrupt the Site (introducing malware, overloading, or scraping in violation of our robots.txt);
• Use the Site to develop or benchmark competing security products in a way that breaches these Terms;
• Reverse engineer the Site except to the extent permitted by applicable law.

Intellectual property

The Site, including its design, text, graphics, logos, and software, is owned by AgenticAssure or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Site for your internal business purposes.

Third-party services

The Site may contain links to third-party websites or services. We are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms.

Disclaimers

THE SITE AND ANY CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTICASSURE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AGENTICASSURE, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID US FOR THE SITE-RELATED SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

Indemnity

You will defend, indemnify, and hold harmless AgenticAssure and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

Termination

We may suspend or terminate access to the Site at any time, with or without notice, for conduct that we believe violates these Terms. Provisions that by their nature should survive will survive termination.

Governing law and venue

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. For disputes not subject to arbitration or another exclusive forum in a separate agreement, you and AgenticAssure consent to the exclusive jurisdiction and venue of the courts of Singapore.

General

These Terms constitute the entire agreement between you and AgenticAssure regarding the Site (subject to separate enterprise agreements for paid Services). If any provision is unenforceable, the remainder remains in effect.
